Outreach Acceptable Use & Liability Policy

1. Purpose
Sales10 ("the Platform," "we," "us") lets your organization ("Customer," "you") send outbound messages and place calls — by email, WhatsApp, SMS, and AI-assisted voice calling — to prospects and contacts you identify. We provide the Platform as infrastructure; we are not the sender of your messages, and we do not review or approve individual outbound communications before they are sent (message templates submitted through Meta's WhatsApp review process are the one exception, reviewed by Meta, not by us).
This Policy governs what you may send through the Platform and states, in advance, where responsibility sits when something goes wrong.
2. Prohibited Use
You must not use the Platform, on any channel, to send or facilitate:
- Threatening, violent, or intimidating content directed at any person.
- Harassment, hate speech, or content that abuses a recipient on the basis of a protected characteristic.
- Content that is illegal in the jurisdiction of the recipient or of your business, including fraud, deceptive impersonation, or unlicensed solicitation.
- Unsolicited bulk messaging sent without a lawful basis to contact the recipient (see Section 3).
- Messages that violate a channel provider's own policies (e.g., Meta's WhatsApp Business Messaging Policy, Twilio's Messaging Policy), where such a violation is reasonably foreseeable to you at the time of sending.
3. Your Responsibility for Contact Basis
You are solely responsible for confirming you have a lawful basis to contact each recipient — including, where applicable, prior consent, an existing business relationship, or another basis recognized under the law governing that recipient (e.g., consent and opt-out requirements under India's IT Act and DPDP Act, the U.S. TCPA/CAN-SPAM, or the EU's ePrivacy Directive/GDPR). The Platform does not verify contact basis on your behalf before a send.
4. Liability and Indemnification
- You are the sender. Content sent through your connected channels — including anything typed by a person on your team, generated by your sequences, or sent by an AI agent acting under your configuration — is your communication, not ours.
- Direct liability. If a message or call sent through your account violates Section 2, is unlawful, or gives rise to a complaint, regulatory inquiry, or legal claim, liability for that communication rests with you (Customer), not with Sales10.
- Indemnification. You agree to indemnify and hold Sales10 harmless against any claim, penalty, or loss arising from your use of the Platform to send content that violates this Policy or applicable law.
This section does not limit any separate liability Sales10 holds for the Platform's own conduct — for example, a failure to honor a data deletion request, or a security failure in how we operate the infrastructure itself.
5. Enforcement
- We may suspend or restrict a connected channel, sender number, or your account without prior notice where we reasonably believe this Policy is being violated, where a channel provider (Meta, Twilio) has flagged your traffic, or where continued sending risks the Platform's standing with a provider.
- We may investigate an abuse report or complaint, which may include reviewing message content, sender configuration, and send patterns for the account in question.
- Suspension under this section is a Platform safety measure, not a determination of legal liability — Section 4 governs liability regardless of whether we suspend an account.
6. Reporting Abuse
A recipient, or anyone else, may report suspected abuse to info@salesten.com. Reports are reviewed by the Data Protection Officer / Grievance Officer.
7. Acceptance
By accepting this Policy, your organization's authorized representative confirms that your organization agrees to the terms above and accepts responsibility, as described in Section 4, for outbound communications sent through your connected channels. Acceptance is recorded once per organization and re-requested whenever this Policy's text is materially revised.
